Algemene Voorwaarden
Als u een afspraak maakt voor een massage of photoshoot, ga ik ervan uit dat u kennis genomen heeft van de onderstaande voorwaarden en hiermee akkoord gaat.
Een afspraak komt tot stand op het moment dat een door cliënt aangevraagde afspraak mondeling, online en/of schriftelijk is bevestigd door Marloes Nierop | Mystic Meeting.
Deze algemene voorwaarden zijn van toepassing op Marloes Nierop | Mystic Meeting gevestigd te Amsterdam, ingeschreven in het handelsregister onder nummer 57210802 en haar cliënten.
Betaling
De prijzen voor een photoshoot en een combinatiedag zijn exclusief btw
De prijzen voor massages en massagetherapie zijn inclusief btw
Betaling voor photoshoots kan per mobiel (via een betalingslink) of per storting (factuur).
Betaling van een massage kan online via www.mysticmeeting.com of ter plaatse gepast contant of per mobiel (via een betalingslinkt)
Factuur kan op aanvraag worden gemaild.
Bij photoshoots op locatie zijn de genoemde kosten exclusief reiskosten en eventuele parkeerkosten.
De geldigheidsduur van een cadeaubon is 1 jaar na datum van betaling.
Prijswijzigingen zijn voorbehouden aan Marloes Nierop en ze behoudt zich het recht, zonder opgaaf van reden(en), de tarieven tussentijds aan te passen, voor nieuwe opdrachten.
Restitutie na aanschaf van een rittenkaart is niet mogelijk. U heeft de keuze om een ander persoon van uw rittenkaart gebruik te laten maken.
Aanbiedingen in advertenties zijn geldig in de aangegeven looptijd en/ of zolang de voorraad strekt.
Gekochte en gekregen cadeaubonnen kunnen niet worden ingewisseld voor contant geld, kunnen niet worden geruild of geretourneerd.
Hygiëne
U kan van mij verwachten dat hygiëne belangrijk is in mijn praktijkruimte en tijdens het geven van de massage.
Deze prioriteit verwacht ik ook van u. Met een schoon lijf op de massagetafel gaan liggen is prettig tijdens het geven en ontvangen van een massage.
Er wordt voor voldoende frisse lucht in de praktijk gezorgd.
Annuleren
Annuleren of wijzigen van een afspraak kan tot uiterlijk 24 uur voor aanvang van de afspraak, daarna wordt 100% van de behandeling per factuur in rekening gebracht.
Bij regen of extreme koude wordt een photoshoot kosteloos verplaatst naar een ander samen overeen te komen moment.
Een massage is niet mogelijk bij ziekte zoals griep, koorts, ernstige verkoudheid, hoge bloeddruk. Bij twijfel informeer bij uw huisarts voordat u komt of uw gezondheidstoestand het toelaat om gemasseerd te worden.
Marloes Nierop is in redelijkheid gerechtigd een reeds geplande afspraak te wijzigen. In dat geval zal zij dit zo snel als mogelijk kenbaar maken.
Behandelingen (massages en massagetherapie)
De behandelingen vloeien voort uit technieken waarvoor diploma’s, licenties en certificaten zijn behaald.
De cliënt is zich er van bewust dat de massage en introspectie sessies als doel hebben het welbevinden te beïnvloeden.
Deelname aan een massage en/of therapeutische sessie geschiedt volledig op eigen risico.
De sessie zal een zelfontwikkeling op gang brengen en hier wordt verwacht dat de deelnemer in staat is om zelfstandig met de opgedane ontwikkelingen om te gaan.
De behandelingen worden individueel en op maat samengesteld/uitgevoerd en kunnen daarom variëren in opbouw en uitwerking.
Informatie
De klant is zelf verantwoordelijk voor het verstrekken van informatie en de juistheid ervan, zodat ik de massage en therapie sessies zo verantwoordelijk en veilig mogelijk uit kan voeren. Deze informatie blijft vertrouwelijk.
Bij ernstige gezondheidsproblemen is er een verplichting om dit te melden aan de therapeut, Marloes Nierop. Zodra er zich relevante wijzigingen voordoen in uw medische gegevens licht u Marloes Nierop in en u zult haar onmiddellijk waarschuwen als uw welbevinden op enige wijze wordt aangetast.
Indien u informatie achterhoudt over eventuele ziektes, blessures e.d. kunt u de behandelaar niet verantwoordelijk stellen voor de resultaten of gevolgen tijdens of na de behandeling.
Het is belangrijk dat Marloes Nierop correct en volledig word ingelicht over jouw gezondheid ook omwille van verzekeringstechnische aansprakelijkheid.
Bij het maken van een afspraak wordt altijd uw email, adres en telefoonnummer gevraagd voor onze administratie.
Aansprakelijkheid
De cliënt is zich er van bewust dat massage therapie niet als vervanging dient voor reguliere medische zorg, diagnose, medicatie en/of advies, enkel ter ondersteuning.
De massages en therapie sessies zijn niet bedoeld om ‘medische condities’ (zoals ziekte, acute of chronische klachten) te diagnosticeren en/of te behandelen. In bepaalde gevallen kan ik, Marloes Nierop, besluiten om af te zien van het geven van een massage of therapie sessie en u doorverwijzen naar een homeopaat/arts/specialist.
Marloes Nierop stelt geen diagnose, hiervoor dient u uw huisarts te raadplegen.
Bent u al onder behandeling van een arts, specialist, therapeut of ander soort behandelaar, of gebruikt u medicijnen dan verwacht ik, Marloes Nierop, dat u met deze arts overlegt of de massage toegepast mag worden.
Door akkoord te gaan met deze voorwaarden verklaard u dat u Marloes Nierop nooit aansprakelijk kan stellen voor enige gevolgen, bijwerkingen en/of nawerkingen die mogelijk het gevolg zouden kunnen zijn van een massage of therapie sessie die aan u is gegeven.
Marloes Nierop kan niet aansprakelijk worden gesteld voor schade als gevolg van door cliënt ondernomen handelingen eventueel voortvloeiend uit de begeleiding of door gegeven adviezen.
Marloes Nierop is niet aansprakelijk voor schade, van welke aard ook, ontstaan doordat deze is uitgegaan van door cliënt verstrekte gegevens en/of onvolledige gegevens.
Houdt u er rekening mee dat er eventueel met massageolie wordt gewerkt en dat dit mogelijk vlekken kan geven in de kleding. Marloes Nierop kan niet aansprakelijk worden gesteld voor eventuele schade aan kleding of andere spullen die u bij zich draagt.
In alle gevallen is iedere aansprakelijkheid van Marloes Nierop beperkt tot het bedrag dat in rekening is gebracht aan cliënt.
Marloes Nierop behoudt zich het recht de massage te weigeren bij personen die onder invloed zijn van alcohol, medicijnen, geestverruimende middelen en bij grensoverschrijdend gedrag van elke aard.
Beeldrechten
Nadat je de foto’s van jouw photoshoot hebt ontvangen en betaald, zijn alle gebruikersrechten van de beelden voor jou. Ik, Marloes Nierop, stel het zeer op prijs als je mijn naam benoemd als je beelden online deelt op je website en/of social media.
Marloes Nierop behoudt het auteursrecht op de beelden en heeft het recht om deze beelden gebruiken voor een van de volgende doeleinden: websites of sociale media-accounts, promotionele publicaties, artikelen en ander marketingmateriaal. Je kan deze toestemming voor het bovengenoemde altijd intrekken. Je begrijpt echter dat reeds gepubliceerde afbeeldingen mogelijk niet volledig kunnen worden verwijderd uit bestaand materiaal.
Marloes Nierop behoudt het auteursrecht om de beelden te verwerken in vormen van collage en andere beeldende kunstvormen en deze kunstwerken te verspreiden en te verkopen. Alle eventuele opbrengsten hiervan zijn geheel voor de beeldend kunstenaar Marloes Nierop.

Privacy
Alle (vertrouwelijke) informatie met betrekking tot de cliënt wordt behandeld volgens de Wet Bescherming Persoonsgegevens.
Gegevens zullen alleen na schriftelijke toestemming van de cliënt aan derden ter inzage.
Geheimhouding vervalt enkel op grond van een wettelijke bepaling of een rechterlijke uitspraak. In dat geval ben ik verplicht om vertrouwelijke informatie te verstrekken aan derden.
Ik doe mijn best om uw privacy te waarborgen. Dit betekent onder meer dat ik: zorgvuldig omga met uw persoonlijke en medische gegevens, er voor zorg dat onbevoegden geen toegang hebben tot uw gegevens.
Een klein deel van uw gegevens wordt gebruikt voor de financiële administratie, zodat ik of mijn administrateur, een factuur kan opstellen. Als ik vanwege een andere reden gebruik wil maken van uw gegevens, dan zal ik u eerst informeren en expliciet uw toestemming vragen.

Wijzigingen
Marloes Nierop behoudt zich het recht om de voorwaarden, prijzen en openingstijden te veranderen zonder kennisgeving vooraf.
De Algemene Voorwaarden en de op de website vermelde informatie kunnen door Marloes Nierop, zonder aankondiging, gewijzigd worden.

General Terms and Conditions
If you make an appointment for a massage or photoshoot, I assume that you have read and agree to the terms and conditions below.
An appointment is made at the moment that an appointment requested by the client is confirmed verbally, online and/or in writing by Marloes Nierop | Mystic Meeting.
These general terms and conditions apply to Marloes Nierop | Mystic Meeting, established in Amsterdam, registered in the trade register under number 57210802 and its clients.
Payment
The prices for a photoshoot and a combination day are exclusive of VAT
The prices for massages and massage therapy are inclusive of VAT
Payment for photoshoots can be made by mobile phone (via a payment link) or by deposit (invoice).
Payment for a massage can be made online via www.mysticmeeting.com or on site in cash or by mobile phone (via a payment link)
Invoice can be emailed upon request.
For photoshoots on location, the stated costs exclude travel expenses and any parking costs.
The validity of a gift voucher is 1 year after the date of payment.
Price changes are reserved by Marloes Nierop and she reserves the right, without giving any reason(s), to adjust the rates in the meantime, for new assignments.
Refunds after purchasing a ticket are not possible. You have the choice to let another person use your ticket.
Offers in advertisements are valid for the stated period and/or while stocks last.
Purchased and received gift vouchers cannot be exchanged for cash, cannot be exchanged or returned.
Hygiene
You can expect from me that hygiene is important in my practice room and during the massage.
I also expect this priority from you. Lying down on the massage table with a clean body is pleasant when giving and receiving a massage.
Sufficient fresh air is provided in the practice.
Cancellation
An appointment can be cancelled or changed up to 24 hours before the start of the appointment, after which 100% of the treatment will be charged per invoice.
In case of rain or extreme cold, a photoshoot will be moved free of charge to another time to be agreed upon.
A massage is not possible in case of illness such as flu, fever, severe cold, high blood pressure. If in doubt, ask your GP before you come whether your state of health allows for a massage.
Marloes Nierop is reasonably entitled to change an already planned appointment. In that case, she will announce this as soon as possible.
Treatments (massages and massage therapy)
The treatments result from techniques for which diplomas, licenses and certificates have been obtained.
The client is aware that the massage and introspection sessions aim to influence well-being.
Participation in a massage and/or therapeutic session is entirely at your own risk.
The session will initiate self-development and it is expected that the participant is able to deal with the acquired developments independently.
The treatments are individually and tailor-made and can therefore vary in structure and effect.
Information
The client is responsible for providing information and its accuracy, so that I can perform the massage and therapy sessions as responsibly and safely as possible. This information remains confidential.
In the event of serious health problems, there is an obligation to report this to the therapist, Marloes Nierop. As soon as there are relevant changes in your medical data, you inform Marloes Nierop and you will immediately warn her if your well-being is affected in any way.
If you withhold information about possible illnesses, injuries, etc., you cannot hold the practitioner responsible for the results or consequences during or after the treatment.
It is important that Marloes Nierop is correctly and completely informed about your health, also for the sake of insurance liability.
When making an appointment, your email, address and telephone number are always requested for our administration.
Liability
The client is aware that massage therapy is not a substitute for regular medical care, diagnosis, medication and/or advice, only for support.
The massages and therapy sessions are not intended to diagnose and/or treat ‘medical conditions’ (such as illness, acute or chronic complaints). In certain cases I, Marloes Nierop, may decide not to give a massage or therapy session and refer you to a homeopath/doctor/specialist.
Marloes Nierop does not make a diagnosis, for this you should consult your GP.
If you are already under treatment by a doctor, specialist, therapist or other type of practitioner, or if you are using medication, I, Marloes Nierop, expect you to consult with this doctor whether the massage may be applied.
By agreeing to these conditions you declare that you can never hold Marloes Nierop liable for any consequences, side effects and/or after-effects that could possibly be the result of a massage or therapy session that has been given to you.
Marloes Nierop cannot be held liable for damage resulting from actions taken by the client, possibly resulting from the guidance or advice given.
Marloes Nierop is not liable for damage of any nature, arising from the fact that it is based on data provided by the client and/or incomplete data.
Please note that massage oil may be used and that this may stain clothing. Marloes Nierop cannot be held liable for any damage to clothing or other items that you carry with you.
In all cases, any liability of Marloes Nierop is limited to the amount charged to the client.
Marloes Nierop reserves the right to refuse the massage to persons who are under the influence of alcohol, medication, mind-altering substances and in the event of transgressive behavior of any kind.
Image rights
After you have received and paid for the photos of your photoshoot, all user rights of the images are yours. I, Marloes Nierop, would greatly appreciate it if you mention my name when sharing images online on your website and/or social media.
Marloes Nierop retains the copyright on the images and has the right to use these images for one of the following purposes: websites or social media accounts, promotional publications, articles and other marketing material. You can always withdraw this permission for the above. However, you understand that already published images may not be completely removed from existing material.
Marloes Nierop retains the copyright to process the images in forms of collage and other visual art forms and to distribute and sell these works of art. Any proceeds from this are entirely for the visual artist Marloes Nierop.

Privacy
All (confidential) information relating to the client is treated in accordance with the Personal Data Protection Act.
Data will only be made available to third parties after written permission from the client.
Confidentiality only lapses on the basis of a statutory provision or a court ruling. In that case, I am obliged to provide confidential information to third parties.
I do my best to guarantee your privacy. This means, among other things, that I: handle your personal and medical data with care, ensure that unauthorized persons do not have access to your data.
A small part of your data is used for the financial administration, so that I or my administrator can draw up an invoice. If I want to use your data for another reason, I will first inform you and explicitly ask for your permission.

Changes
Marloes Nierop reserves the right to change the conditions, prices and opening hours without prior notice.
The General Terms and Conditions and the information stated on the website can be changed by Marloes Nierop, without notice.
